By downloading and using this Application, these terms will apply to you – you should make sure therefore that you read them carefully before using the Application.
These Regulations define the rules of using the Spicy Stories Mobile Application (the Application). The owner of the Application and the provider of services rendered through it is NOKINTO Sp. z o. o. with its registered office in Szkolna Street 7/9a 22-300 Krasnystaw Poland (Service Provider).
The Application provides a collection of interactive, erotic & romance stories, enriched with sounds and illustrations. The Application is intended for adult users only due to its erotic content (the Users). You must be at least 18 years old to create an account on the Application and use it. By creating an account and using the Application, you confirm that you will use it in accordance with its intended purpose, in a manner consistent with the law and good practices, taking into account the respect for personal rights, copyrights and intellectual property of the Service Provider, other Users and third parties. You can download the Application from digital distribution platforms with applications: from the App Store or Google Play (for Android). In the case of Google Play, the Application can be downloaded by all users of mobile devices with at least Android 4.2 or newer version. Remember that every user of the App Store and Google Play is also bound by the terms and conditions set out therein ( App Store regulations - App Store, and Google Play regulations PL version & US version). We may wish to update the Application from time to time – the requirements for Android system (and for any additional systems we decide to extend the availability of the Application to) may change, and you will need to download the updates if you want to keep the Application running. Please mind, that an active Internet connection is required for downloading, launching and proper operation of the Application, as well as its updates.
You may download the Application free of charge. However, using the Application itself and reading episodes requires having points that are deducted from your balance. Every episode costs given amount of points. We may organise promotions from time to time that will help you gain points free of charge. We reserve our right to limit number of free points you may gain by logging into the App via your Facebook account as well as withdraw promotions at any time without providing any reason.
To get more points and continue reading more episodes, you are required to purchase points via Google Play. In order to do that, you must have a Google Payments account and agree to the Google Payments Terms of Service (PL version & US version). Google Payments offers multiple payment options like: debit cards, credit cards, Paysafecard, PayPal, bonus codes etc. yet please mind that only Google runs and is responsible for this payment service and it may be subject to change at Google’s sole discretion. If you have any additional questions regarding Google Pay and its current payment options, please feel free to contact Google support directly.
If you are using the Application outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the Application, or other third party charges. In using the Application, you are accepting responsibility for any such charges, including roaming data charges if you use the Application while being abroad without turning off data roaming. If you are not the bill payer for the device on which you’re using the Application, please be aware that we assume that you have received permission from the bill payer for using the Application.
In order to use the Application, you may sign in using your Facebook account. If you do so, you authorize us to access and use certain Facebook account information, including but not limited to your Facebook profile picture, username, e-mail address and date of birth. You may also use the Application as “unsigned user” and do not give us access to those personal data, in this case however, you may have limited access to the Application eg. comment section will not be visible to you so you will be unable to read comments and insert yours. That is why we recommend you to sign in via Facebook account.
The use of the Application is possible for an indefinite period of time. You can stop using the Application at any time and without providing us any reason at all. To delete the Account, you can send us a simple request via email to the address: email@example.com or by post to the address Szkolna Street 7/9a 22-300 Krasnystaw, Poland.
We reserve the right to suspend you the use of the Application in the following cases:
Your Account can be suspended for a definite or indefinite period of time. You cannot use the Application during the Account suspension. During the suspension of the Account, you should take actions to remove the reasons for its suspension, and after their removal, you should inform us about this fact. In this case we may reopen the Account after the reason for its suspension ceases.
If suspension of your Account lasts more than 30 calendar days and the reasons for its suspension do not cease, we have the right to terminate your agreement to use the Application immediately and delete the Account.

Any complaints related to the functioning of the Application and the provision of services through the Application can be submitted by e-mail email@example.com by our feedback form or by post: Szkolna Street 7/9a 22-300 Krasnystaw, Poland.
We recommend that the complaint includes: information and circumstances concerning the subject of the complaint, in particular the type and date of the irregularity; claim; contact details of the person lodging the complaint - this will facilitate and speed up handling the complaint. The requirements in the preceding sentence are in the form of a recommendation only and do not affect the effectiveness of complaints made without the recommended description of the complaint.
We shall respond to the complaint immediately, not later than within 14 calendar days from the date of its lodging.
Please note that, if you are a consumer, you have a statutory right to withdraw from a distance contract in 14 days time period since the day you purchased points via Google Pay. If you wish to use this right, please contact us via email mentioned in Complaints section above. However, please mind, that our episodes are digital content and therefore, at the moment you actually spend your points and get access to any content we provide you via the Application, you waive your statutory right of withdrawal.
The Application may contain advertisements and promotions offered by third parties and links to other web sites or resources. We are not responsible for the availability (or lack of availability) of such external websites or resources. If you choose to interact with the third parties made available through our Application, such party’s terms will govern their relationship with you. We are not responsible or liable for such third parties’ terms or actions.
We are entitled to take action at any time to verify the accuracy, reliability and precision of the information provided by you. During the verification referred to in the preceding sentence, we are entitled to suspend your Account for the duration of the verification.
We can terminate the agreement for the use of the Application with immediate effect and without indicating the reasons by sending to you a relevant statement, and delete the Account.
We reserve our right to amend the Regulations including but not limited to situations like changes in legal regulations; changes in the scope or form of services provided under the Application - to the extent that such changes affect the implementation of the provisions of these Regulations.
The Regulations come into force on 10.06.2020r.
The Controller of personal data is NOKINTO Sp. z o. o. e-mail address: firstname.lastname@example.org hereinafter referred to as: the “Controller”) During the registration of the account in the Application, as well as during the use of the Application, the Service Provider may request you to provide personal data in order to perform the services provided by the Controller via the Application. Your personal data are processed under the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) dated 27 April 2016 (Official Journal of the European Union L No. 119, p. 1) (hereinafter referred to as: “GDPR”).
Each time, the purpose, scope and the recipients of data processed by the Controller result from actions taken by you in the Application. In order to conclude and perform the agreement on the use of the Application, the Controller may process your following personal data: Facebook username, Facebook profile picture, e-mail address, date of birth and - if required by the use of the Application - other data necessary for its performance indicated while using the Application.
The recipients of personal data will be other entities providing appropriate services related to the maintenance of the Application, hosting, administration and management of the service, entities cooperating in the provision of services with the Controller, consulting and legal companies.
The obtained personal data can be processed throughout the entire period of holding the Account and using the Application.
The grounds for processing your personal data is the necessity to perform the agreement to which you are a party or to take action before concluding it (Article 6 (1)(b) of the GDPR).
You have the right access your personal data, right to rectification, erasure or restriction of processing, or to object to processing as well as the right to data portability.
You have the right to lodge a complaint to the supervisory authority, which is the President of the Office for Personal Data Protection (postal address: ul. Stawki 2, 00-193 Warsaw, Poland).
Cookies are files with a small amount of data that are commonly used as anonymous unique identifiers. These are sent to your browser from the websites that you visit and are stored on your device's internal memory. This Application does not use these “cookies” explicitly. However, the Application may use third party service providers that use “cookies” to collect information and improve their services. In general you will have the option to either accept or refuse these cookies and know when a cookie is being sent to your device. If you decide to use third parties service via the Application, please always read carefully privacy policies of third party service providers. Please rest assured, that we shall apply technical and organizational measures ensuring the protection of the processed personal data appropriate to the threats and categories of data subject to protection, and in particular we shall protect the data against unauthorized access, removal by an unauthorized person, processing in breach of applicable regulations, and alteration, loss, damage or destruction.
